The Difference in Laws
If you are 21 or older, the legal blood alcohol content (BAC) level is .08. However, for people who are under the age of 21, the legal limit is .02. For most people, that means even one drink would put them at or over the legal limit.
People who are convicted of underage drinking and driving automatically lose their license for 60 days or until they are 21, whichever is longer.
Consequences of Underage Drinking and Driving
People aged 18 and younger who are caught drinking and driving may be charged in juvenile court. Juvenile courts typically offer more flexibility with punishments and convictions. Teens are often given a curfew and are prohibited from drinking alcohol. Some teens are also issued SCRAM bracelets (Secure Continuous Remote Alcohol Monitor), which monitor the level of alcohol in the body.
